Ga. top court upholds conviction in Emanuel County killing

ATLANTA, Ga. (WRDW/WAGT) – The Georgia Supreme Court on Thursday upheld the felony murder conviction of Da’Korey Somerville in the 2019 shooting death of Jamichael Walker outside a local gambling game room in Emanuel County. Somerville was tried in December 2022 alongside co-defendants Jerel Bostic and Timothy Wright. The Supreme Court affirmed Bostic’s and Wright’s convictions last year, and prosecutors later dismissed a Street Gang Terrorism and Prevention Act charge against all three. Their remaining convictions stand. Justices said the evidence showed Somerville was more than just present when Walker was shot outside a local gambling “game room” on March 27, 2019. Witnesses placed Somerville there with Bostic and Wright, and investigators linked a shell casing from the scene to a 9mm Glock recovered from Somerville’s vehicle, which records showed he bought four days before the killing. The court also rejected Somerville’s claims that his rights were violated by testimony from a Georgia Bureau of Investigation agent and by a jury instruction where the judge accidentally said “fight” instead of “flight,” noting the written charge sent to jurors used the correct wording. Somerville remains sentenced to life in prison plus five years in Walker’s death. Copyright 2026 WRDW/WAGT. All rights reserved.
