Judge allows Fulton County to collect property taxes despite incomplete data

ATLANTA, Ga. (Atlanta News First) — A judge has allowed Fulton County officials to temporarily collect real and personal property taxes despite a crucial legal document remaining incomplete. On Monday, the county said the 2026 Tax Digest — which assesses properties and assigns taxes — is missing land parcel entries and hasn’t been turned in to the Georgia Department of Revenue for approval. And without approval, the county wouldn’t be able to collect taxes without a judge’s order, meaning employees wouldn’t be paid, the county couldn’t settle its debts and school districts wouldn’t receive funding. In her Tuesday order, Fulton County Superior Court Judge Shukura Ingram authorized the temporary collection. Bills will be collected based on 2025 millage rates and the 2026 Board of Assessors’ property values. Once the 2026 Tax Digest is complete, residents may be rebilled. If a taxpayer overpaid, they will be refunded with interest. The cities of Alpharetta, Milton and Roswell are excluded from the order. This is a developing story.
